Austin Tourist Park in Tamworth NSW is participating in a test case involving insurer HDI Global Specialty, which will be fast-tracked to the NSW Court of Appeal.

The test case commencing October 2 comprises two separate small business claims lodged with the Australian Financial Complaints Authority.

The hearing will examine if clauses within the claimants’ Business Interruption Policies stand, given they refer to the Australian Quarantine Act 1908 which was repealed in 2016.

The Biosecurity Act 2015 is the current legislation.
